The petitioner seeks regular bail in connection with Isuwapur P.S. Case No. 138 of 2021 registered for the offence punishable under Section 498 (A) of the Indian Penal Code, 1860 and 3⁄4 of Dowry Prohibition Act, 1961.
As per prosecution case, the allegation against the petitioner is that he along with his family members indulged in dowry torture with the informant.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He has never indulged in the alleged dowry torture. There is general and omnibus allegation against the petitioner. However, the petitioner is ready to keep the informant with all honour and
Patna High Court CR. MISC. No.30878 of 2023(2) dt.15-06-2023 2/2 dignity. He has no criminal antecedent and is in jail custody since 27.01.2023. The Charge sheet has already been submitted. Learned APP appearing for the State has opposed the prayer for regular bail of the petitioner.
Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist, Saran at Chapra in connection with Isuwapur P.S. case No. 138 of 2021.
