JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-10-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners seek pre-arrest bail in connection with Kudhani P. S. Case No. 246 of 2017 registered under Sections 147, 148, 149, 323, 307, 504, 354, 427 and 379 of the Indian Penal Code.
It is contended that the present case is counter blast of Kudhani P. S. Case No. 258 of 2017 dated 26.06.2017 lodged by petitioner no. 2 Mala Devi against the father of the present informant Ghanshyam Bhagat and others. It is further contended that there is general and omnibus allegation of assault upon
Patna High Court Cr.Misc. No.46001 of 2017 (2) dt.03-10-2017 2/2 these petitioners while specific allegation is upon Raju Rai and Kalpatiya Devi. It is also contended that though 17 persons have been made accused only one injury has been found grievous in nature.
Learned Additional Public Prosecutor for the State has opposed the application for grant of pre-arrest bail to the petitioners.
Considering the nature of the allegation and the submissions made above, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur in Kudhani P. S. Case No.246 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
