JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147, 148, 149, 323, 307, 342, 504, 506 of the Indian Penal Code and under section 3(1) (x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
The prosecution case is that when the she-buffalo of the petitioners started grazing the crop of the informant then the informant started warding off the she-buffalo. Thereafter, the accused persons abused and assaulted the informant. It is alleged
Patna High Court Cr.Misc. No.2566 of 2016 (2) dt.18-01-2016 2/2 that petitioner No.1 assaulted the informant with Lathi and petitioner No.3 assaulted the daughter of the informant with Lathi. It is specifically alleged that petitioner No.2 assaulted the nephew of informant with Lathi.
It is submitted by the learned counsel for the petitioners that all the injuries have been found to be simple in nature and there is counter version of the occurrence. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Jamui SC/ST P.S. case No. 53/2015 pending in the court of learned ACJM, Jamui This application is disposed of with the aforesaid observation/direction.
