Heard learned counsel for the petitioners and learned A.P.P for the State.
The petitioners seek bail in Turkauliya (Raghunathpur O.P.) P.S. Case No. 219 of 2020, registered for the offence punishable under Sections 188, 269, 270, 447, 341, 323, 324, 326(A), 307, 504 and 34 of the Indian Penal Code and section 3 of the Epidemic Disease Act and section 51 of the Disaster Management Act.
Patna High Court CR. MISC. No.24222 of 2020(3) dt.06-10-2020 2/2 As per the prosecution case, on 15.04.2020 at 7 'O' clock, all the accused persons including these petitioners variously armed came at the door of informant and started abusing him. Petitioner no. 1 is alleged to have assaulted by Dabia which caused injury on his palm. Thereafter, all the accused persons including petitioner no. 2 threw acid on the informant causing injury on his back.
It is submitted on behalf of the petitioners that petitioners have falsely been implicated in this case. There is general and omnibus allegation. Petitioners are in custody since 16.04.2020 having no criminal antecedent.
Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioners abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
