Although, the writ petition challenges the notice issued by the Sub-Divisional Officer under Bihar Agricultural Land (Conversion into Non-agricultural Purposes) Act, 2010 but the Counsel for the State, drawing attention of the Court to paragraph 7 of the application, however, points out that upon filing of the reply pursuant to the notice impugned in the present writ application, an order appears to have been passed by the SubDivisional Officer (the competent authority) which has, however, not been enclosed and challenged.
Be that as it may, since the stand of the petitioner is that no order adjudicating on the rights of the petitioner in respect of the land has been passed by the Sub-Divisional Officer, I am inclined to dispose of the application by directing the concerned
Patna High Court CWJC No.2549 of 2014 (2) dt.04-08-2016 2/2 authority to pass order in the pending proceeding, if not already passed, in accordance with law.
I order accordingly.
