23-12-2016 Heard Sri Ajay Thakur, learned counsel assisted by Sri Amit Kumar, learned counsel for the petitioner and Sri Shailendra Kumar Singh, learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Warsaliganj P.S. Case No. 248 of 2016 registered for offence under Sections 419, 420, 34 of the Indian Penal Code and Section 10 of Bihar Conduct of Examination Act, 1981, has prayed for grant of bail in the event of arrest or surrender. It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated in the present case. A plea has been taken that after completion of examination, by mistake, petitioner had left his Admit Card and thereafter, he requested his brother to collect the Admit Card. Subsequently, his

Patna High Court Cr.Misc. No.55053 of 2016 (3) dt.23-12-2016 2/2 brother was apprehended on allegation that he had appeared at examination in place of petitioner.

The plea, which was taken by the learned counsel for the petitioner, appears to be appreciative, but for the purposes of grant of anticipatory bail, it has got no substance. Dismissed.
