JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-07-2018 The petitioners seek bail in anticipation of their arrest in connection with Saharsa Sadar P.S. Case No. 1333 of 2017 dated 20.12.2017 instituted for the offences under Sections 341, 323, 447, 308, 379, 504, 506, 34 of the Indian Penal Code.

The informant and others were assaulted at the hands of the petitioners.

The learned counsel for the petitioners has submitted that there is a land dispute between the parties and the allegation is general and omnibus in nature. The petitioners are next door neighbours and the occurrence arose out of a

Patna High Court Cr.Misc. No.32164 of 2018 (4) dt.02-07-2018 2/2 trivial issue. The injuries suffered by the informant and others are stated to be simple in nature.

Considering the aforesaid facts, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 1333 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
