The petitioner is in custody in connection with Madhepura P.S. Case No. 1425 of 2024 for the offence punishable under sections 309(6) of the BNS lodged on 18.12.2024 by the informant, Vikram Kumar.

3. As per the prosecution story, the informant alleged that while on a motorcycle, the accused persons intercepted and after abusing/assault, took away the motorcycle. This led to the FIR.

4. Subsequently, the Police investigated the matter and the motorcycle was recovered from the house of the

Patna High Court CR. MISC. No.26491 of 2025(4) dt.13-08-2025 2/2 petitioner.

5. Learned counsel for the petitioner submits that once the case is lodged, repeatedly the Police implicates. However, learned APP submits that not only the recovery is from the house, number of criminal cases are under his belt as per paragraph 3 of the petition.

6. Considering the submissions of the parties as also the criminal antecedent that he has, coupled with the fact that the recovery is from his house, for the present, this Court is not inclined to extend him the privilege of bail which is accordingly rejected.
