2. The petitioner seeks bail in connection with Barhara (Raghuvansh Nagar O.P.) P.S. Case No. 329 of 2021, instituted for the offences punishable under Sections 302, 307, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

3. The prosecution case, in short, is that the petitioner and other co-accused persons allegedly, in furtherance of a land dispute, fatally shot the informant's wife while she was in the field and also attempted to kill the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the

No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submits that the allegation levelled against the petitioner is general and omnibus in nature. The petitioner has been named in this case only due to land dispute between the parties. The petitioner has not committed any such offence as alleged against him. The petitioner is in custody since 21.05.2025 and has got two criminal antecedents in which he has been acquitted in one case.

5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner and submits that the petitioner is named in the FIR and there is specific allegation of firing levelled against the petitioner. Hence, the petitioner does not deserve the privilege of bail.

6. In compliance of the order dated 24.06.2026, a report dated 02.07.2026 with regard to the present stage of trial has been received. From perusal of the aforesaid report, it appears that charge has been framed against the petitioner on 10.07.2025. It is further reported that out of thirteen chargesheeted witnesses, only three witness have been examined in this case.

7. Considering the aforesaid facts and circumstances of the case, nature of accusation and the gravity of the offence and present stage of the case, this Court is not inclined to grant bail to the petitioner.

8. The prayer is rejected. The trial Court is directed to expedite the Trial.
