JUSTICE RAMESH KUMAR DATTA ORAL ORDER 09-07-2015 Mr. Y.V.Giri, learned Sr.Counsel for the petitioner appearing along with Mr.Vikash Ratan Bharti, Advocate on Record, seeks permission to withdraw the writ application with liberty to approach the Civil Court against the orders of confirmation passed under the Bihar Bhoodan Yagna Act, 1954 by the Revenue Officer with the prayer that the interim order passed

Patna High Court CWJC No.3646 of 1996 (15) dt.09-07-2015 by this Court on 8.7.1998 directing the respondents not to dispossess the petitioner from the land in dispute, if not yet dispossessed, until further orders, be continued till order of the Civil Court on application for interim relief. Learned counsels for the respondents have no objection. The writ application is, accordingly, dismissed as withdrawn with the aforesaid liberty.

It is directed that the interim order passed on 8.7.1998, which was continued by order dated 12.4.1999, shall remain in operation provided the suit/suits is/are filed in the Civil Court within a period of two months from today along with an application for appropriate interim relief until the said application is first considered by the Civil Court.
