The petitioner apprehends his arrest in Darbhanga Sadar P.S. Case No. 233/2016, registered for the offences punishable under Sections 307, 325 and other sections of the Indian Penal Code and Sections 3 and 4 Witch Practices Act. The informant alleged that petitioner assaulted his wife and also knocked her down thrice by the speeding Auto-rickshaw. Learned counsel for the petitioner submits that informant is brother-in-law of the petitioner. Informant was residing in the house of the petitioner, as Gharjamai and that is why this false case has been lodged, but it appears that wife of the informant was brutally assaulted and repeatedly knocked down by the speeding

Patna High Court Cr.Misc. No.49145 of 2016 (2) dt.16-12-2016 2/2 Auto-rickshaw. She got as many as four grievous injuries besides, other injuries on her body.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
