2. In the present case, the petitioner seeks bail in connection with Tekari P.S. Case No. 295 of 2019, registered for the offences under Sections 409 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner being Panchayat Sachiv is that he did not hand over the documents related to employment of teachers from the year 2003-2015 to the authorities on demand.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner was not even posted as Panchayat Sachiv from the year 2003-2015 as the post was being held by one Upendra Prasad who was suspended with

No.30260 of 2026(2) dt.11-05-2026 2/3 effect from 24.02.2015 for dealing with Government documents in an arbitrary manner and he did not hand over charge of the Panchayat Sachiv for Sanda Panchayat to this petitioner for quite long time. The petitioner has submitted an application along with the relevant documents to the Block Education Officer, Tekari. Therefore, the petitioner has no role in not handing over the documents to the authorities. The petitioner has antecedent of three cases and he is on bail in all the three cases. The petitioner is in custody since 21.02.2026 and charge sheet has been submitted.

5. Learned APP appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the submission of charge sheet against the petitioner and also considering his period of custody, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned ACJM-VI, Gaya/concerned court, in connection with Tekari P.S. Case No. 295 of 2019, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
