JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-11-2020 Heard Mr. Manohar Prasad Singh, learned counsel for the petitioner and Mr. Kumar Veerendra Narayan, learned counsel appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Sessions Trial No. 135 of 2020 arising out of Asthawan P.S. Case No. 06 of 2019 registered for the offence under Section 342 / 304 (B) / 201 / 120(B) of the I.P.C.

The allegation as per the First Information Report is that the daughter of the informant was married to one Ram Baran Paswan and after marriage all the accused persons including the husband of the deceased started demanding Rs. 50,000 /- as dowry and due to non fulfillment of the demand, the daughter of the informant has been killed by the accused persons.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case along with other family members. Learned counsel further submits that the

No.23934 of 2020(4) dt.23-11-2020 2/2 petitioner is the sister- in- law (gotni) of the deceased and she has been residing in her Maika with her parents for the last many years and has nothing to do with the family affairs of the deceased and her husband. Learned counsel further submits that petitioner has been arrested from her Maika and has been rotting in jail since 12.02.2020.

Having heard learned counsel for the parties and taking into consideration the materials available on record , I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. District and Sessions Judge, Nalanda at Bihar Sharif / court concerned in connection with S. Tr. No. 135 of 2020 arising out of Asthawan P.S. Case No. 06 of 2019.

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
