2. The petitioner seeks pre-arrest bail in connection with Sanjhauli P.S. Case No. 10 of 2018 registered for the offence(s) punishable under Sections 30(a), 32(c) of the Bihar Prohibition and Excise Act and Sections 272 and 273 of the Indian Penal Code.

3. As per the allegation made in the FIR, 17.28 litres of illicit liquor was recovered from a car bearing Registration No. BR1X - 9849.

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is innocent and has falsely been implicated in the present case. He further submitted that petitioner is not the owner of the car. Petitioner has clean

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the nature of allegation made against the petitioner, the District Court is directed to call for a report from the District Transport Officer, concerned with respect to the actual owner of the motorcycle. In case, it is found that the said car is not registered in the name of petitioner and the same is also not a stolen one, in that case the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the learned District Court within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No.2, Rohtas at Sasaram / Concerned Court in connection with Sanjhauli P.S. Case No. 10 of 2018, subject to the conditions as laid down under Section 482(2) of the BNSS.
