The petitioner seeks regular bail in a case registered under sections 302, 307, 147 and 393 of the Indian Penal Code and section 27 of the Arms Act.

Informant who happens to be the truck driver has alleged that three accused persons got on his truck and started indiscriminate firing leading to the death of co-driver and he himself having sustained gun shot injuries.

It is submitted by learned counsel for the petitioner that the FIR was registered against three unknown. Petitioner's name has figured during course of investigation in confessional statement of co-accused Gulsan Kumar, who has already been allowed bail by a co-ordinate bench of this Court vide order passed in Cr.Misc.No. 5167/2021. No other substantive

Patna High Court CR. MISC. No.37625 of 2021(2) dt.07-01-2022 2/2 evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case. Petitioner is in custody since 29.9.2020. Test Identification Parade has not been carried out till date.

Considering the facts of the case, prayer for bail of the petitioner is allowed. Let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bikramganj in Bikramganj P.S. Case no. 55 of 2020).
