The petitioner seeks bail in a case registered under Sections 20/22 of the N.D.P.S. Act.

Allegation is that huge quantity of of intoxicated drungs have been recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.01.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on disclosure made by co-accused. There is no recovery of any incriminating article from the conscious possession of the petitioner. The petitioner has been made accused due to mistake of fact. Recovered

Patna High Court CR. MISC. No.29308 of 2019(3) dt.17-05-2019 2/2 articles are said to be alopathy medicines and cough syrup. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessionscum-Special Judge, Araria in connection with Special case No.12 of 2018 corresponding to Jogbani P.S. case No.146 of 2018.
