2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 395, 397 of the Indian Penal Code.
3. Petitioner along with other accused persons are said to have took Rs. 1,59,000/- including Aadhar Card, PAN card, voter I Card, Bike Owner Book, D.L. key of motorcycle, mobile set etc. and fled away towards Jandaha.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the petitioner has been made accused in this case on the basis of confessional statement of co-accused. He submits that there is no specific overt act against the
Patna High Court CR. MISC. No.28624 of 2023(4) dt.03-10-2023 2/2 petitioner. He further submits that petitioner has three criminal antecedent of similar nature as stated in para-3 of the bail application.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the case and the fact that petitioner has three criminal antecedent of similar nature, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Rajapakar P.S. Case No. 69 of 2019. (Anjani Kumar Sharan, J) devendra/- U T
