JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 13-12-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Pear P.S. Case No. 19 of 2016 registered for the offences punishable under Sections147, 148, 149, 341, 323, 332, 353, 504, 506 of the Indian Penal Code.

Allegedly, ten named accused persons including the petitioner and one unknown person had obstructed the movement on public road and had kept the dead body of Vijay Choudhary. When the Police intervened, the named accused persons and unknown used criminal force against the Police party just causing obstruction in discharging of their official duty. Submission is of false implication and that similarly situated co-accused Raj Kumar Paswan and Ramesh Sah have been allowed pre-arrest bal vide Cr. Misc. No. 32268 of 2016 and 46016

Patna High Court Cr.Misc. No.47276 of 2016 (2) dt.13-12-2016 of 2016 to which learned A.P.P. fairly submits that two co-accused have been allowed pre-arrest bail.

In the facts and circumstances stated above, the petitioner above named, in case of his surrender or arrest within six weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge 5-cum-A.C.J.M., Muzaffarpur in connection with Pear P.S. Case No. 19 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
