The petitioner seeks bail in connection with Laukaha P.S. Case No. 89 of 2024 instituted for the offence under Sections 317(4) & 317(5) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution alleges that during night patrolling on 04.12.2024, police chased a suspect who fled, leaving behind a motorcycle. Subsequent search led to the recovery of another suspicious motorcycle from the suspect's residence, and the petitioner was later arrested based on a tip-off. 4.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 05-12-2024. Petitioner
Patna High Court CR. MISC. No.28980 of 2025(2) dt.13-05-2025 2/3 bears two criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. The petitioner's counsel contends that the F.I.R. is a fabricated story created by the informant-chaukidar in collusion with the police, following a prior altercation between the petitioner and local residents with the said chaukidar. It is argued that no stolen motorcycle or incriminating material was recovered from the petitioner's house or possession, and the allegations are baseless. The petitioner further claims that the investigation lacks support from any independent witnesses and appears to be driven by personal vendetta, as the chaukidar sought revenge against the petitioner for raising concerns about his non-performance. It is lastly submitted that police after completion of investigation has submitted charge sheet in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.
Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the
Patna High Court CR. MISC. No.28980 of 2025(2) dt.13-05-2025 3/3 petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Laukaha P.S. Case No. 89 of 2024.
