====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 17-02-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Jamui P.S. Case No. 563 of 2019/ G.R. Case No. 3184 of 2019 for the offence under Sections 302/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, petitioner has been made accused in this case merely on the basis of suspicion and no cogent material has come during course of investigation against the petitioner. Moreover, the petitioner has not been named in the F.I.R. and his name has transpired in this case on the confession of co-accused Suraj

The petitioner is rotting in judicial custody since 21.11.2019. Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Jamui P.S. Case No. 563 of 2019/ G.R. Case No. 3184 of 2019.
