Petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 353, 333, 399, 402 of the Indian Penal Code, 25(1B) (a),26,27,35 of the Arms Act and Section 30(a) 37(b)(c),38(ii) of Bihar Prohibition and Excise Act, 2016.

Submission is that nothing incriminating was recovered from possession of the petitioners. The petitioners

Patna High Court CR. MISC. No.26509 of 2019(2) dt.23-04-2019 2/2 were apprehended on suspicion as they are resident of the adjoining village and some of them are of the same village. Petitioners have got no criminal antecedent.

Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Khirimore Police Station Case No.10 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
