The petitioners, namely, Anand Kumar Jha and Vijay Kumar Sinha @ Vijay Kumar Singh, apprehend their arrest in Kanti P.S. (Panapur) Case No. 270/2016 registered under Sections 420, 406, 467, 468, 471 of the Indian Penal Code. The informant alleged that Nawal Kishore Patel had established a Women Self Help Group in the year 2002, in the name of Bhagwati Mahila Swayam Sahayata Samuh, which comprised 10 members. He entrusted Bashishtha Singh and his wife Asha Devi to see the work and functioning of the said Women Self Help Group. It is alleged that rupees two lacs were withdrawn by Bashishtha Singh and his wife in collusion with the then Branch Manager and the Cashier of the Bank but only Rs.
Patna High Court Cr.Misc. No.39452 of 2016 (2) dt.16-09-2016 2/2 1,40,000/- was credited in the account of the Women Self Help Group. It is submitted that the petitioners are the Branch Manager and the Cashier of the Bank. The petitioners did not commit any illegality. In the month of August, Rs. 2,00,000/- was credited in the account of Bhagwati Mahila Self Help Group and on the same date Rs. 60,000/- was withdrawn by Bashishtha Singh and his wife but the informant has also made the petitioners accused without verifying the bank statements.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., West, Muzaffarpur in Kanti P.S. (Panapur) Case No. 270/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
