Mr.Rajendra Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-06-2024 At the outset, learned counsel for the petitioners seeks permission to make correction in paragraph - 1 and prayer portion of the bail petition.
2. Permission is accorded. It may be done in course of the day.
3. The petitioners apprehend their arrest in a case registered for the offence under Sections 302/201/34 of the Indian Penal Code.

4. As per the prosecution case, informant's daughter (deceased) was married with co-accused Chandan Kumar 15-16 years ago, but after the marriage, all the accused persons including these petitioners subjected her to torture and harassment due to non-fulfillment of demand of dowry. On 14.11.2023, co-accused Chandan Kumar informed on mobile phone of informant that his daughter is ill and when informant was going to see his daughter, again co-accused Chandan Kumar informed that his daughter is dead and before informant reached at matrimonial house of his daughter, all the accused persons fled away after disposing of the dead-body of his daughter.

It is submitted on behalf of petitioners that petitioner no. 1 is father-in-law, petitioner no. 2 is Devar, petitioner no. 3 is Gotani, petitioner no. 4 is Gotani, petitioner no. 5 is married Nanad and petitioner no. 6 is Nandosi of deceased. Petitioners have been falsely implicated in this case with general and omnibus allegation only with a view to harass and extract money from the informant. It is further submitted that as a matter of fact, deceased died due to cardiac arrest. Moreover, the husband of the deceased is already in custody since 21.03.2024. Petitioners claim clean antecedent.

6. Learned A.P.P. for the State has opposed the bail petition.
7. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul (Katahara O.P.) P.S. Case No. 496 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
