2. Heard learned counsel for the State-respondents as well as respondent no. 8.

3. Petitioner is one of the accused of Jagdishpur Police

Patna High Court Cr. WJC No.676 of 2013 dt.04-08-2017 2/2 Station Case No. 237 of 1994 which is based on Compliant Case No. 719(C) of 1994 lodged by private-respondent no. 8 Md. Safique under Sections 304B and 201/34 of the Indian Penal Code.

4. The allegation is of commission of dowry death of Sahjahan. Subsequently, the victim-girl appeared and in her statement under Section 164 Cr.P.C. stated that she was being tortured by her inlaws and even rape was committed by one of the members of the family. Therefore, she had left the house.

5. In the background of recovery of the victim, the writ application was filed for a direction to the respondent-authorities to take stern disciplinary action against the officials as well as private respondents who in their league implicated the petitioner and his family members in a case under Section 304B of the Indian Penal Code.

6. Apparently the victim has levelled some serious allegation against the petitioner and others. In the circumstances, the petitioner might have lost interest in the case, hence, this writ application is dismissed for non-prosecution.
