Petitioners apprehend arrest in connection with Mehus P.S. Case No. 24 of 2013 registered under Sections302, 201/34 of the Indian Penal Code. The informant, who happens to be the present petitioner no. 1, alleged that her Bhaisur alongwith other accused persons brutally assaulted her husband. It is alleged that her husband died and accused took him for the purpose of hiding the dead body.
Learned counsel for the petitioner submits that petitioners have been falsely implicated in this case. Petitioners
Patna High Court Cr.Misc. No.54191 of 2016 (3) dt.28-01-2017 2/2 have no criminal antecedent.
Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that from the case diary it appears that there was much communication between the present petitioners, who are informant and witness to the written information. Further, cognizance has been taken under section 306, 201/34 of the Indian Penal Code. Considering the aforesaid facts and circumstances and the submissions of the parties, I do not feel inclined to grant the privilege of anticipatory bail to the petitioners. Their prayer for anticipatory bail is, accordingly, rejected. (Arvind Srivastava, J) Manish/- U T
