The petitioner seeks bail in Sessions Trial No. 557 of 2018 arising out of Tilauthu P.S. Case No. 76 of 2018, instituted for the offence under Section(s) 324, 326, 307, 302 and 120B of the Indian Penal Code.

This is a case of tripple murder.

In the written report there is specific allegation against the petitioner that he has assaulted nephew of the informant Golu Kumar aged about 3 years from spade (Kudal) on account of which, he died during course of treatment. From the written report it appears that two persons also namely, Lalsi

Patna High Court CR. MISC. No.27314 of 2019(4) dt.12-07-2019 2/2 Devi and Chhotu Kumar were assaulted, on account of which, they died on the spot.

Case diary has been received.

The post mortem report is available in the case diary wherein the Doctor has found injury on the head of Golu Kumar and cause of death has been opined by the Doctor due to head injury on account of haemorrhage and shock caused by hard and blunt substance.

Therefore, this Court is not inclined to grant bail to the petitioner.
