2. The writ petition has been filed seeking a direction to the respondents to amend Clause 3.2 of the Tender paper, which mandates that a bidder must have minimum total turn-over of Rs. 5 Crores during the last three financial years in printing work.

3. The learned counsel for the petitioner has submitted that a suggestion was given in the pre-bid meeting as the condition, referred to above, was very onerous and the petitioner in all probability would have been excluded from consideration, despite the fact that he had been working for the society for the same work for the last several years.

4. However, the fact of the matter is, as told to this Court by Mr. K.K. Sinha, learned counsel for the Bihar State Health Society that the suggestions given by the petitioner were accepted. The Clause 3.2, referred above, of the tender papers was modified. Despite this, the petitioner did not come out successful in the Tender

5. In that view of the matter, nothing remains in this petition to be decided. The petition has already become infructuous.
