JUSTICE KISHORE KUMAR MANDAL ORAL JUDGMENT Date: 05-08-2016 Heard Mr.Birendra Kumar, the counsel for the petitioner and Mr. Lokesh Kumar Singh, A.C to AAG 13 for the State. Where the building of Angan Bari Centre, Kajichak shall be constructed is an issue raised in this writ application by the petitioner claiming himself a resident of the said Panchayat. According to the petitioner, such building is required to be constructed under the Building Development Project sponsored by the Union of India. As per guidelines of the Department of Social Welfare, initially the building was to be constructed in Ratani Faridpur Block. Now the

Patna High Court CWJC No.2886 of 2014 dt.05-08-2016 respondents intend to change the location thereof inasmuch as certain land has been obtained by way of gift from another individual. The writ application seeks a direction upon the respondents to construct the building of Anganbari Centre in Gram Panchayt Ratani Faridpur Block.

The Court is not required to investigate such matter. No legal right of the petitioner has been infringed. These are purely administrative/executive decisions. However, if there is any deviation from the given pattern, the petitioner may ventilate his grievance before the appropriate authority who may make an inquiry and pass appropriate orders in accordance with law. Mr. Kumar states that the District Magistrate is the authority where the petitioner may ventilate his grievance. The writ application is disposed off permitting the petitioner to ventilate his grievance before the respondent- District Magistrate, Jehanabad. Once such an application /representation is filed, I am sure, the respondent District Magistrate, Jehanabad will bestow consideration thereon and pass an appropriate order in accordance with law.

The writ application stands disposed off.
