The present application has been filed for modification of order dated 26.07.2017 passed in Cr. Misc. No. 14420 of 2017 firstly to the extent that the period of surrender could not be typed in the order. Secondly, the case is pending in the Court of learned ACJM-X, Gaya, but it has been recorded as ACJM-XII, Gaya.

It appears that the second mistake perpetuated in the order since it was wrongly mentioned in the main petition. Learned counsel for the petitioner is permitted to make necessary correction in the main petition. Considering the grounds taken for

Patna High Court Cr.Misc. No.50833 of 2017 (2) dt.08-11-2017 2/2 modification, the order dated 26.07.2017 passed in Cr. Misc. No. 14420 of 2017 is modified to the extent that the learned Judicial Magistrate, to consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned Court below within a period of six weeks from today in connection with Fatehpur P.S. Case No. 217 of 2013, pending in the Court of learned ACJM-X, Gaya.

Accordingly, this modification application is disposed of.
