The petitioner apprehends his arrest in Forest Case No.1 of 2019 registered under Sections 33, 41 and 42 of Indian Forest Act and under Sections 2, 27 and 29 of Wildlife (Protection) Act.

The S.S.B. intercepted a tractor bearing registration No.BR-22T-5428 but the driver of the tractor managed to flee away. The tractor was found loaded with boulders. The learned counsel for the petitioner submits that the petitioner is the owner of the tractor. The land of the petitioner is situated in village Ghegwalia by the side of the forest. After flood, some pieces of stones deposited in the field of the petitioner and the petitioner was taking those pieces of stones

Taking into consideration the facts aforesaid and nature of allegation made against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Forest Case No.1 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
