The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 379 and 201 of the Indian Penal Code.

As per the prosecution case, the son of the informant who used to drive the tempo owned by one Sohan Sah was informed by the said Sohan Sah that his son did not return with the tempo. Subsequently, his dead body was found. It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in the confessional statement of co-accused Santosh Kumar made before police. Inspite of being in custody since 10.10.2020, the petitioner has not been put on T.I. parade

Patna High Court CR. MISC. No.37729 of 2021(3) dt.04-02-2022 2/2 and chargesheet has been submitted in the case. The petitioner has no criminal antecedent. His case stands on a similar footing to that of co-accused Sanjay Sahni who has been enlarged on bail vide order dated 16.12.2021 passed in Cr. Misc. No. 26531 of 2021.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for more than 1 year and grant of bail to the above named co-accused, the petitioner is directed to be enlarged on bail in connection with Deepnagar P.S. Case no. 308 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif.
