JUSTICE ARVIND SRIVASTAVA ORAL ORDER 11-12-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Govindganj P.S. Case No. 12 of 2017 registered under Sections 324, 307, 302/34 of the I.P.C. pending in the Court of A.C.J.M.-I, Motihari, East Champaran.

Submission of learned counsel for the petitioner is that petitioner is quite innocent and has falsely been implicated in this case. The occurrence took place due to dispute between the agnates with regard to the property.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending

Patna High Court Cr.Misc. No.49227 of 2017 (3) dt.11-12-2017 2/2 that petitioner is named in the F.I.R. and there is direct allegation of burn injury.

Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.

However, petitioner is directed to surrender before the Trial Court and pray for regular bail, which may be decided considering his age.
