The petitioner apprehends his arrest in Narpatganj (Bathnaha) P.S. case No. 80 of 2019 registered under Section 30(a) of the Bihar Prohibition & Excise Act.

The S.I., SSB got information about transportation of liquor but the motorcyclists fled away. The people assembled there disclosed the name of petitioner and Jyotish Paswan who managed to flee away after leaving the motor cycle on the spot. The learned counsel for the petitioner submits that petitioner is not the owner of motor cycle. He had no manner of concern with the motor cycle or the recovered 8.4 liter Nepali liquor.

Taking into consideration the facts that petitioner is not the owner of motor cycle and the name of petitioner figured

No.27302 of 2019(2) dt.29-04-2019 2/2 in the case on the disclosure made by the villagers but the name of villagers who identified the petitioner have not been disclosed, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Araria in connection with Narpatganj (Bathnaha) P.S. case No. 80 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
