====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-09-2020 Heard Mr. Ratanakar Jha, learned counsel for the petitioner and Mr. Satyendra Prasad Singh, learned A.P.P. for the State.

This is the second attempt of the petitioner to obtain regular bail in connection with Laukahi P.S. Case No. 239 of 2019 corresponding to G.R. No. 2229 of 2019 registered for the offences punishable under Sections 272, 273, 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that earlier the prayer for bail was rejected considering the period of custody and he was given liberty to renew his prayer for bail after expiry of a reasonable period. It is submitted that now the

Learned A.P.P. for the State is present and has though opposed the prayer for regular bail of the petitioner, considering the facts and circumstances of the case, wherein the petitioner has now remained in custody for more than nine months, let the petitioner above named be released on bail in connection with Laukahi P.S. Case No. 239 of 2019 corresponding to G.R. No. 2229 of 2019 on furnishing of bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District Judge-cum-Special Judge (Excise), Madhubani, subject to the condition as laid down under Section 437 (3) Cr.P.C.

And further condition that they will abide by and observe the guidelines and directives of the Government of India and the State Government with regard to COVID-19 Pandemic.
