The petitioner seeks pre-arrest bail in connection with Phulwariya P.S. Case No.118 of 2017 registered under Sections 147, 148, 149, 323, 307 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
It is submitted by the learned counsel for the petitioner that so far as the petitioner is concerned, there is no whisper in the first information report that he committed any offence or participated in any manner in the alleged offence. The specific allegation in the first information report is against Manoj Roy and Sanjay Roy, who opened fire causing injury to the informant. On the other hand learned counsel for the State
Patna High Court Cr.Misc. No.22106 of 2018 (2) dt.26-04-2018 2/2 submitted that the petitioner is named in the first information report as one of the accused armed with Danda. Considering the submissions made above, since the petitioner is not alleged to have assaulted any one, in the event of arrest or surrender in the court below within six weeks from today, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Phulwariya P.S. Case No.118 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
