It is submitted by Mr. Arvind Kumar, learned counsel appearing on behalf of the petitioner that till date, the order dated 13.01.2022 passed in Cr. Misc. No. 46975 of 2021 has not been carried out in the manner this Court had directed to release the petitioner. The court is sitting tight over the bail application of the petitioner which is violative of the Article 21 of the Constitution of India. He submits that he is affected by the condition in which this Court had directed to seek report from the concerned Superintendent of Police having jurisdiction with respect to pending cases, if any, against the petitioner. Taking into consideration the aforesaid submission

Patna High Court CR. MISC. No.25541 of 2022(2) dt.18-05-2022 2/2 made on behalf of the petitioner, no substantial modification has been sought by him.

In such circumstances, this Court directs the court below to seek report with respect to details of pending cases pending against the petitioner from the concerned Superintendent of Police having jurisdiction well within a period of two months.

If such report is not furnished, the petitioner shall be released forthwith, if he fulfills other terms and conditions imposed in the order dated 13.01.2022 passed in Cr. Misc. No. 46975 of 2021.

Accordingly, this modification application stands disposed of.
