This application is for grant of anticipatory bail for the offence under Sections 409, 272 and 273 of the Indian Penal Code and Section 47 (A), (C), (G), (F) of the Excise Act. It is submitted on behalf of the petitioner that nothing has been recovered from the possession of the petitioner rather 48 bottle of whisky was recovered from the Bank of the River and there is nothing available on the record to show that the petitioner is connected with them.

Having heard both sides and in view of the facts that
Patna High Court Cr.Misc. No.45455 of 2016 (3) dt.19-12-2016 2/2 nothing has been recovered from the possession of the petitioner, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of SDJM, Biraul at Benipur (District- Darbhanga) in connection with Kusheshwar Asthan P.S.Case No.74 of 2014, subject to conditions as laid down under Section (2) of the Code of Criminal Procedure.
