JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-12-2020 Heard Mr. Manish Kumar No. 13, learned counsel for the petitioner and Mr. Nawal Kishore Prasad, learned counsel appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Town P.S. Case No. 247 of 2019 registered for the offence under Section 363 / 366 (A) / 506 / 34 of the I.P.C. The allegation as per the First Information Report is that the petitioner abducted the daughter of the informant. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case. Learned counsel further submits that the girl has been recovered. Referring to Annexure - 3 to the bail application learned counsel submits

No.28514 of 2020(4) dt.22-12-2020 2/3 that the statement of the victim girl has been recorded under Section 164 of the Cr.P.C. and from perusal of the same it would be evident that the victim girl has not stated anything against the petitioner and she has categorically stated that she is in love with the petitioner.
On the other hand, learned counsel for the State submits that the petitioner was the teacher of the victim girl and was having the moral responsibility not to entice the girl. However, learned counsel for the State submits that charge sheet has already been submitted in the matter.
Having regard to the submissions made by the parties and taking into consideration the materials available on record , the fact that in her statement recorded under Section 164 of the CrP.C. the victim girl has not stated anything against the petitioner and charge sheet has already been submitted in this case and the petitioner is in custody since 30.01.2020, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga / court concerned in connection with Town P.S. Case No. 247 of 2019.
