The petitioners apprehend their arrest in Sahodara P.S. Case No.35 of 2017 registered under Section 30(a) of Bihar Prohibition and Excise Act.

On the basis of secret inputs, the informant raided a place from where liquor was recovered. The informant alleged that persons who were preparing the liquor fled away and also disclosed the name of the persons who were involved in preparing liquor.

The learned counsel for the petitioners submits that the petitioners were not apprehended on the spot. Similarly situated 10 accused persons have already been granted

Patna High Court CR. MISC. No.27925 of 2019(2) dt.29-04-2019 2/2 anticipatory bail vide order dated 09.01.2019 passed in Cr. Misc. No.78522 of 2018.

Taking into consideration the facts aforesaid and the fact that the similarly situated co-accused have already been granted anticipatory bail, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bettiah, West Champaran in connection with Sahodara P.S. Case No.35 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
