JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-06-2019 The only issue involved in the present writ petition is with regard to recalculation of interest on delayed payment of the retiral dues of the petitioner.

The learned counsel for the respondents submits that on the head of interest on delayed payment, a sum of Rs. 2 lacs has already been paid, however, the same is disputed by the learned counsel for the petitioner and he submits that some more amount is required to be paid with regard to interest on the delayed payment of the retiral dues.

This Court finds that disputed question of facts cannot be adjudicated in a writ petition under Article 226 of the

Patna High Court CWJC No.8671 of 2019(4) dt.25-06-2019 2/2 Constitution of India, hence the petitioner may take recourse to appropriate remedies available to him including filing of a suit, if so advised.

The writ petition stands dismissed with the aforesaid liberty.
