This writ petition has been filed for the following relief(s):- "For issuance of direction to The Executive Engineer, Building Construction Department, Building Division, Motihari, East Champaran to ensure payment of admitted dues of the petitioner of Rs. 4,50,506/- with respect to work already executed in terms of Agreement no. 139-F2/2023-24 and the Executive Engineer, Building Construction Department, Building Division, Motihari already

Patna High Court CWJC No.7012 of 2025(2) dt.29-07-2025 2/3 granted permission for withdrawal of aforementioned amount."

3. Learned counsel for the petitioner states that pursuant to the works contract issued to the petitioner, the petitioner has completed the works. That the petitioner after completion of the work has submitted the bills for an amount of Rs. 4,50,506/- but till date the amounts are not paid. Learned counsel seeks a direction from this Court to the authorities to pay the admitted dues amount for the works which was executed in the year 2023-24.

In the counter affidavit filed by the respondents, it is not denied that the petitioner has not done the work however it is stated that Executive Engineer, Building Construction Department, Building Division, Motihari has requested the District and Sessions Judge, Motihari to grant approval for the work which was done by the petitioner and they are awaiting granting of approval. It is further stated that as soon as when the approval is received, the authorities are willing to clear the dues of the petitioner.

5. Having regard to the same, the present writ petition is disposed of directing the District and Sessions Judge, Motihari duly take into consideration the letter issued by the

Patna High Court CWJC No.7012 of 2025(2) dt.29-07-2025 3/3 Executive Engineer, Building Construction Department, Building Division, Motihari and also the bills submitted by the petitioner and see that the necessary approvals are given as expeditiously as possible preferably within a period of four weeks from the date of receipt of the copy of this order. That after receipt of the approval from the District and Sessions Judge, Motihari, the official respondents are directed to pay the necessary amounts to the petitioner.

6. Registry is directed to forward the copy of this order to the District and Sessions Judge, Motihari.

7. The present writ petition stands allowed to the extent indicated.
