The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 506 of the Indian Penal Code.
As per the prosecution case, it is stated by the informant that his mother was killed by accused Bittu Kumar Shahi.
It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. His name transpired in the confessional statement of the FIR named co-accused Bittu Kumar Shahi made before police in course of investigation wherein he allegedly stated that he had committed the murder at the instance of this petitioner. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the material that has transpired in course of investigation and the petitioner having remained in custody for 1 year, the petitioner is directed to be enlarged on bail in connection with Aurai P.S. Case no. 12 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Muzaffarpur.
