21-09-2017 Learned counsel for the petitioner, at the very outset, requests for allowing her to make correction in paragraph - 1 of the petition to the extent of correcting "Section 372" as "Section 272".

The prayer is allowed. It may be done in course of the day.

Heard Ms. Manisha Prakash, learned counsel for the petitioner and Sri Nand Kishore Prasad, learned Addl. Public Prosecutor.

The petitioner, who is a lady and wife of one Jiwachh Yadav, has approached this Court with a prayer to grant bail in the event of her arrest or surrender in Khajauli P.S. Case No. 49 of 2017 registered for offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

No.44512 of 2017(2) dt.21-09-2017 2/2 It was submitted by learned counsel for the petitioner that only because of the fact that petitioner is wife of one Jiwachh Yadav, from whose grocery shop recovery of 2.4 liter of country-made liquor was shown, she has been made accused and petitioner is having clean antecedent.

Considering the fact that petitioner is a lady and from shop of her husband, such recovery was effected, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Amirkala Devi @ Amirkla Devi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IIIrd, Madhubani in connection with Khajauli P.S. Case No. 49 of 2017, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Rakesh Kumar, J.) anay U T
