JUSTICE SANJAY KUMAR SINGH) 11-12-2025 Instant Criminal Appeal, arising out of judgment of conviction and order of sentence dated 06.06.1998 and 08.06.1998 respectively passed by 3rd Additional Sessions Judge, Saharsa in Sessions Trial No. 184 of 1996 (Kishanpur PS case no. 16 of 1994) is listed for hearing.

2. Despite repeated calls, none appears on behalf of the appellant, whereas Mr. Satyendra Narayan Prasad, Learned, Additional Public Prosecutor for the State is present.

3. Perusal of record shows that vide letter dated 04.07.2025 of Assistant Registrar, Criminal Appeal Section of this Court, a living status report of accused appellant was called for. In response thereto, Superintendent of Police, Supaul submitted a report dated 28.07.2025 based on the information furnished by SHO, Kishanpur Thana apprising this Court that

Patna High Court CR. APP (DB) No.363 of 1998(9) dt.11-12-2025 2/2 the sole appellant namely, Upendra Yadav has died around 20 years ago during pendency of this Criminal Appeal.

4. In view of the above, the instant Criminal Appeal filed by appellant namely, Upendra Yadav stands abated.
