The petitioner is in custody in connection with Kotwa P.S. Case No. 45 of 2019, registered for the offence punishable under Section 30 (a), 35 and 38 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel for the petitioner further submits that in the instant case total 21.75 liters liquor was seized. Learned counsel for the petitioner further submits that the recovery was made from the hut and not from the conscious possession of the petitioner. Learned counsel for the petitioner submits that petitioner is in custody since 15.03.2019.

Let the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge VIIth-cum- Special Judge, Excise, East Champaran at Motihari in connection with Kotwa P.S. Case No.45 of 2019.
