JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 25-01-2016 The prayer of the petitioner in the present application preferred under Articles 226 and 227 of the Constitution of India as narrated in para-1 is as under :

"1. That this is an application for issuance of an appropriate writ/writs, order/orders, direction/directions for the following reliefs : i. To issue a writ of prohibition directing the learned court below to not proceed in the case bearing Ghosi (Okari) P.S. Case No.100 of 2013 till the Final Report submitted by the police in pursuance to the order dated 6.12.2013 passed by the learned Chief Judicial

Patna High Court Cr. WJC No.335 of 2015 (2) dt.25-01-2016 2/2 Magistrate, Jehanabad by which the learned court below directed the I.O. for further investigation under Section 173(8) of Cr.P.C. but till date the outcome of the further investigation has not been submitted by the I.O.

ii. Also for any other relief/reliefs for which the petitioner is found to be entitled in the eye of law."

In my view, the prayer made in the present application is thoroughly misconceived. Accordingly, this application is dismissed.
