JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 19-02-2021 Heard Mr. Zeyaul Hoda, learned counsel for the petitioners and Mr. Umanath Mishra, learned Additional Public Prosecutor (hereinafter referred to as the 'APP') for the State.
2. The petitioners apprehend arrest in connection with (Chhaurahi OP) Khodawandpur PS Case No. 203 of 2019 dated 21.09.2019, instituted under Sections 341/323/353/504/34 of the Indian Penal Code and Section 135 (1) of the Electricity Act, 2003.
3. After some arguments, learned counsel for the petitioners submitted that since, for the present, he has no
Patna High Court CR. MISC. No.28062 of 2020(3) dt.19-02-2021 2/2 apprehension of arrest, he may be permitted to withdraw the application. However, he submitted that the Court may grant him liberty to move again, if so required.
4. Learned APP does not object.
5. In view thereof, as prayed for by learned counsel for the petitioners, the application stands disposed off as withdrawn with liberty aforesaid.
