Public Prosecutor.

The petitioner prays for anticipatory bail in connection Sirdala PS case no. 160 of 2016 registered for the offence punishable under Section 354(B), 379 and other sections of Indian Penal Code.

It is submitted on behalf of petitioner that case and counter case is pending between the parties and so far allegation under Section 354(B) is concerned, it is totally ornamental in nature.

Heard learned A.P.P. and learned counsel for informant. They have opposed the prayer for bail. Having heard both sides. I find that this is not a fit

Patna High Court Cr.Misc. No.45590 of 2016 (3) dt.23-01-2017 2/2 case to grant anticipatory bail to the petitioner. As such, his prayer for anticipatory bail is rejected at this stage. However, petitioner is directed to surrender before the court below for regular bail and the court below will dispose of the matter on its own merit without being prejudiced by the order of this Court and considering the fact that there is case and counter case pending between the parties and allegations are same in both the case.

With these observations, this bail application is disposed of.
