2. The petitioner seeks bail in connection with Madanpur P.S. Case No. 383 of 2025 registered for the offence under Sections 140(3) of the BNS and later Sections 103(1), 61(2), 238, 3(5) of the BNS have been added.

3. As per the prosecution case, the petitioner and others are accused of killing the deceased.

4. The petitioner is in custody since 30.09.2025.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He further submits that in the confessional statement of the co-accused Chotu Kumar and Bilendra, it has come that they are the assailants of the deceased and the petitioner has

Patna High Court CR. MISC. No.27598 of 2026(3) dt.01-07-2026 2/2 caught hold of the deceased. He next submits that similarly situated co-accused namely Upendra Bhuiyan has already been granted bail by this Court vide order dated 24.03.2026 passed in Cr. Misc. No. 526 of 2026.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below in connection with Madanpur P.S. Case No. 383 of 2025.
