====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------ 09-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Dhamdaha P.S. Case No.128 of 2014 registered under Sections 406, 420, 467, 468, 471, 120(B) and 295-A of the Indian Penal Code.

The informant has alleged in the fardbeyan that one Girija Devi claimed to double the amount within a month and got deposited the money from him and several people with the help of her other associates but the money was not returned as per assurance.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that Girija Devi asked

No.47065 of 2016 (3) dt.09-01-2017 2/2 the informant and others to deposit the money, which would be doubled within a month, and the petitioner is not the associate of Girija Devi rather it has only come in the F.I.R. that this petitioner made protest when the informant had gone to take money from Girija Devi. No allegation has been made against the petitioner either to ask the informant and others to deposit the money or the petitioner was involved, in any way, in the transaction of the money.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri L.B. Paswan, Judicial Magistrate, First Class, Purnea, in connection with Dhamdaha P.S. Case No.128 of 2014, subject to the conditions laid down under Section 438(2) Cr.P.C.
